Description of Service
The Second Medical Opinion Service (“SMO”) offered by Access Net Health (“ANH”) allows patients to request a synchronous and/or asynchronous, as applicable, second medical opinion or consultation with a physician/provider within the ANH’s network.
The SMO service is available to customers availing it independently (self-paid) and to those benefiting from the service as part of their insurance plan or healthcare program.
Availing the SMO is subject to the present terms and conditions.
Limitations of the Service
Any person availing the SMO service shall acknowledge and agree that:
- The SMO service differs from in-person diagnostic services typically provided by a physician. The physician/provider delivering this service will not have the same level or quality of information that would be obtained through an in-person examination or consultation.
- The quality of the SMO service depends on the quality, accuracy and completeness of the information provided to the physician/provider. The patient or the person contacting the SMO physician/provider shall be fully responsible to provide full, complete and accurate information regarding the case.
- The SMO service is not intended to replace a diagnosis generated following a full medical evaluation and in-person examination by a physician/provider.
- The patient might not have direct contact or physical examination with the physician/provider rendering the SMO consultation. The absence of a contact or physical examination may affect the physician/provider’s ability to opine on the case.
- The SMO service is subject to availability and appropriateness of the requested physician/provider. ANH will notify you if your SMO service request cannot be fulfilled.
- ANH reserves the right to deny any request for a SMO service at its own discretion.
- ANH might arrange for the SMO through its third-party business partners.
Any person availing the SMO service shall do so being fully aware of the above limitations.
Limitation of Liability
- ANH does not offer any warranty or assurance of any kind whatsoever with respect to the availability, quality, accuracy and/or result of the SMO service.
- ANH’s role is limited to making the SMO service available to its customers. ANH shall not bear liability of any kind whatsoever with respect to the choice and/or availability of the physician/provider offering the SMO or to the quality of care and the medical services they offer and the consequences thereto.
- Without prejudice to the above, ANH shall not bear any liability whatsoever with respect to any claim arising out or in connection with the SMO service.
Fees & Payment
- Customers availing the service as part of their insurance plan or healthcare program shall not be required to make any payment with respect to the SMO service, unless their plan or program states otherwise.
- Customers availing the service independently (self-paid), will be required to pay the fee of the SMO service in advance. The fee for the SMO service shall cover the costs related to the SMO in addition to the ANH administrative fees. Such fees shall not include the costs related to any exams, scans or laboratory tests required for the SMO. ANH will notify the person requesting the SMO of the applicable fees and costs prior to processing the request for SMO.
Privacy
Availing SMO service entails exchanging personal information, including medical information (and medical history) between multiple parties. Such transfer and exchange of data is inherent to the nature of the service.
The patient’s medical information will be handled with strict confidentiality, privacy and security.
In order for ANH to make the SMO service available and to make the necessary arrangements, ANH will collect the patient’s personal information including, without limitation:
- Name, date of birth, email address, phone number, and country
- Gender, marital status, and membership ID when provided
- The medical field of concern and who the opinion is for
- Medical history, current medications, and surgical history
- Uploaded medical records
- The physician selected for the consultation
ANH might use such information for training, statistical and research purposes.
ANH will store the data only for the period and duration necessary to comply with the applicable statutes of limitation on the relevant liabilities.
ANH will only share the patient’s personal information, including medical information, only to the extent required, with the following parties:
- The physician/provider providing the SMO and/or the physician/provider who has requested the SMO;
- The third party arranging for the SMO;
- The insurer and/or administrator of the insurance plan or healthcare program for approval purposes.
ANH will collect the patient’s consent when and where legally required to make any exchange or transfer of personal data (including medical information).
I HAVE READ AND UNDERSTOOD THE INFORMATION IN THIS AGREEMENT. BY NOTING “YES, I AGREE” BELOW, I AGREE TO THIS AGREEMENT AND THE TERMS AND CONDITIONS OF THE SMO SERVICE.
